Terms of service
These Terms of Service (hereinafter referred to as "these Terms") establish the conditions for using the online shop (hereinafter referred to as "this Service") provided on this website by Vaqutaux Japan Co., Ltd. (hereinafter referred to as "the Company").
All registered users (hereinafter referred to as "Users") are required to use this Service in accordance with these Terms.
Article 1 (Application)
- These Terms apply to all relationships between Users and the Company regarding the use of this Service.

- The Company may deny an application for registration if it determines that any of the following conditions apply, and it is not obligated to disclose the reason for denial:
- The applicant provides false information during registration.
- The applicant has previously violated these Terms.
- The Company deems the registration inappropriate for any other reason.
Article 3 (User ID and Password Management)
- Users are responsible for managing their user ID and password for this Service.
- Users must not transfer, lend, or share their user ID and password with third parties. If a login occurs with a matching user ID and password, the Company will consider it to be the User who registered that ID.
- The Company is not liable for any damages caused by a third party using a User’s ID and password, except in cases of intentional misconduct or gross negligence on the part of the Company.
Article 4 (Sales Agreement)
- A sales agreement is considered established when a User submits a purchase request, and the Company sends an acceptance notice.
- The ownership of the product transfers to the User when the Company hands the product over to the shipping carrier.
- The Company may cancel a sales agreement without prior notice if:
- The User violates these Terms.
- The delivery address is unknown, or the User is absent for an extended period, preventing delivery.
- The Company determines that the trust relationship between the Company and the User has been damaged.
Payment methods, shipping methods, order cancellations, and returns are subject to separate rules established by the Company.
Article 5 (Intellectual Property Rights)
- Copyrights and other intellectual property rights related to product photos and other content provided through this Service (hereinafter referred to as "Content") belong to the Company or legitimate rights holders.
- Users must not copy, reproduce, modify, or reuse the Content without prior authorization.
Article 6 (Prohibited Actions)
Users must not engage in the following activities while using this Service:
- Violating laws or public order and morals
- Engaging in criminal activities
- Infringing on copyrights, trademarks, or other intellectual property rights
- Disrupting or damaging the Company's servers or networks
- Using information obtained through this Service for commercial purposes
- Interfering with the operation of this Service

The Company is not responsible for any damages incurred by Users or third parties due to the suspension or interruption of this Service.
Article 8 (Usage Restrictions and Account Termination)
The Company may, without prior notice, restrict a User’s access to all or part of this Service or delete their account if:
- The User violates any provision of these Terms.
- False information is discovered in the User’s registration details.
- The User’s registered credit card is suspended.
- The User fails to fulfill payment obligations.
- The User does not respond to the Company’s communications within a reasonable period.
- The User has not used this Service for an extended period.
- The Company deems the User’s use of this Service inappropriate.
The Company is not responsible for any damages incurred by the User as a result of these actions.
Article 9 (Account Cancellation)
Users may cancel their account at any time through the designated procedure.
Article 10 (Disclaimers and Warranty Exclusions)
- The Company does not guarantee that this Service is free from defects (including security flaws, reliability issues, accuracy, completeness, effectiveness, or legal compliance).
- The Company is not responsible for any damages incurred by Users through the use of this Service. However, if this contract falls under consumer contracts as defined by the Consumer Contract Act, this disclaimer does not apply. Even in that case, the Company is not liable for any special damages arising from non-performance of obligations or unlawful acts.
- The Company is not responsible for any transactions, communications, or disputes between Users and third parties related to this Service.
Article 11 (Changes to Service Content)
The Company may modify or discontinue this Service without prior notice and bears no responsibility for any damages caused to Users as a result.

The Company may change these Terms at any time without prior notice. Users who continue using this Service after changes have been made are considered to have agreed to the updated Terms.

Notifications and communications between Users and the Company shall be conducted using the methods specified by the Company. If the Company does not receive a change request from a User, it will assume that the current registered contact details are valid and will send notifications accordingly. These notifications will be considered received at the time they are sent.
Article 15 (Prohibition of Rights and Obligations Transfer)
Users may not transfer or use as collateral their contractual status or rights and obligations under these Terms without prior written consent from the Company.
Article 16 (Governing Law and Jurisdiction)
- The interpretation of these Terms shall be governed by the laws of Japan. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Service.
- If any dispute arises in relation to this Service, the court having jurisdiction over the Company’s head office location shall be the exclusive agreed-upon court of jurisdiction.
